Terms and Conditions of Hire
The terms and conditions of hire are applicable to Snap & Slay and all its affiliates.
The Provider – Snap & Slay
The Customer – The person booking the provider for their event.
The following contract and its terms will set forth an agreement between the provider including sister websites, and the customer for the hire of the Photo Booth.
This written contract sets forth the full, written intention of both parties and supersedes all other written and/or oral agreements between the parties.
SERVICE PERIOD
The Provider agrees to have a Photo Booth operational for a minimum of 80% during this period; operations may need to be interrupted for maintenance of the Photo Booth.
PAYMENT
A 50% deposit is typically required at the time of booking, the remaining balance is due 14 days prior to your event or billed via a raised Purchase Order (PO). If the operator uses the equipment for a time period in excess of the service period agreed to, the overage in rental time will be billed to the operator.
Payment and rates for any overage in time must be agreed upon before additional hours are provided.
ACCESS, SPACE & POWER
The Customer will arrange for an appropriate space for the Photo Booth at the event venue(s).
The Customer is responsible for providing power (1 standard UK 13amp 3 pin socket) per Photo Booth.
INTERNET CONNECTIVITY (If required)
The Customer is responsible to check that the event’s venue(s) will have adequate SIGNAL for an Internet connection.
We will usually provide our 4G Mobile Broadband Dongles Free of Charge if the Mobile Phone Signal is adequate.
If it is not adequate, the Internet can be granted in the form of a non-public WiFi (e.g. a designated WiFi connection) or a hardwire (Ethernet connection).
As a last resort, we will try to connect to a Free – Public Wifi.
We will not be responsible for any downtime of services due to poor/inadequate Internet connectivity. E.G Blackspots or Firewall Restrictions.
DATE CHANGES & CANCELLATIONS
Any request for a date change must be made in writing at least 14 days in advance of the original event date. Change is subject to availability and receipt of a new booking contract.
If there is no availability for the alternate date, the deposit shall be forfeited and the event cancelled.
In the event that the Customer cancels the event without prior request to the provider, the customer agrees that they are liable for the full payment of the invoice. Cancellations may incur small fees and are at our discretion.
Your deposit is non-refundable however, we will move your hire date if requested. At our discretion, a full refund will be issued minus any costs leading up to the cancellation date.
Your final payment is non-refundable unless Snap & Slay do not provide a Photo Booth hire for you.
COVID-19 GOVERNMENT RESTRICTIONS
In the event of any government-imposed restrictions to events and venues that affect our hire services, you may be able to cancel due to the circumstances related to Coronavirus.
If your cancellation falls under this category, we will offer a credit to be used for your future event(s). At our discretion, a full refund will be issued minus any costs leading up to the hire date.
In the event that the Customer cancels the event when no government-imposed restrictions are active, the DATE CHANGES & CANCELLATIONS terms will apply.
COVID-19 PHOTO BOOTH USAGE
Guests using the photo booth and props provided by Snap & Slay and its subsidiaries acknowledge the contagious nature of COVID-19 and voluntarily assume the risk they may be exposed to or infected by COVID-19 by using the photo booth and/or props.
Such exposure or infection may result in personal injury, illness, permanent disability, and death. Guests understand that the risk of becoming exposed to or infected by COVID-19 at the photo booth may result from the actions, omissions, or negligence of others.
DAMAGE TO THE PROVIDER’S EQUIPMENT
The Customer acknowledges that it shall be responsible for any damage or loss to the Provider’s Equipment caused by any misuse of the Provider’s Equipment by The Customer or its guests.
INDEMNIFICATION
The Customer agrees to, and understands the following:
a) The Customer will indemnify the provider against any and all liability related to The Customer’s Event during or after The Customer’s event. The Customer will indemnify The Provider from the time of service and on into the future, against any liability associated with The Customer.
b) The Customer will indemnify The Provider against any and all liability associated with the use of pictures taken with the Photo Booth, its representatives, employees or affiliates at The Customer’s event.
c) The email, social sharing kiosk, basic guestbook and any props are a free addition to the hire and if for any reason the free additions are not working or unavailable, the customer is not entitled to a refund and accepts this.
d) In the unlikely event of your digital images being corrupt, lost or stolen, Snap & Slay will compensate up to the total value of 25% of the hire fee.
The Customer agrees to and understands the following: All guests using the Photo Booth hereby give Snap & Slay: The right and permission to copyright and use, photographic portraits or pictures and email addresses of any user who may be included intact or in part, made through any and all media now or hereafter known for illustration, art, promotion, advertising, trade, or any other purpose. In addition, I, hereby release, discharge and agree to save Snap & Slay from any liability that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
MISCELLANEOUS TERMS
If any provision of these terms shall be unlawful, void, or for any reason unenforceable under Contract Law, then that provision, or portion thereof, shall be deemed separate from the rest of this contract and shall not affect the validity and enforceability of any remaining provisions, or portions thereof. This is the entire agreement between The Provider and The Customer relating to the subject matter herein and shall not be modified except in writing, signed by both parties. In the event of a conflict between parties, The Customer agrees to solve any arguments via arbitration. In the event Provider is unable to supply a working Photo Booth for at least 80% of the Service Period, The Customer shall be refunded a prorated amount based on the amount of service received (this is £50 per hour, or the percentage of, using this figure). If the printer fails to print out photos on site the Provider will be allowed to give a website to the customer where their guests can log onto and order prints free of charge with free postage.
If no service is received, The Provider’s maximum liability will be the return of all payments received from the Customer.
The Provider is not responsible for any consequential damages or lost opportunities upon breach of this agreement.
